Our cover letter to submit Oct 6, 2020 with our application for the referendum:
Utah County Clerk,
The County Commission jointly issued the Utah County Health Order on Sept 22, 2020 with the county Health Department. The County Commission then subsequently ratified that order on Sept 30, 2020. The Utah Constitution Article VI Sec 1 guarantees the rights of the citizens to file a referendum on any local law or ordinance and have that law submitted to the voters BEFORE the law or ordinance may take effect. Exercising our collective constitutional rights we filed a referendum with the County and the Health department on Sept 28, 2020. As such please accept this as an additional referendum on the County Commission ratification of that order on Sept 30, 2020 by a 2-3 Vote.
Please let me know what additional items you need from me and when they are due, as well as let me know what date you expect that you will allow us to start to gather signatures.

The Supreme Court on Friday was unanimous in ruling Whitmer had no authority under a 1976 emergency law to extend the emergency past April 30 without approval from the Legislature. But the court split 4-3 in ruling that a separate law Whitmer was using to issue executive orders — the 1945 Emergency Powers of the Governor Act — was unconstitutional because it was an unlawful delegation of legislative powers.
Both are issues that need to be litigated in Utah as both are emergency act does not let an emergency continue without joint resolution of the legislature....and the Governors orders violate the separation of powers clause. Making health orders based off an illegal order from the Governor is unjustified.
